Florida Statute Changes

Recent changes to FL Statute 718.111 now require proof of personal homeowners insurance be provided to the association. In addition, there were other changes that you should discuss with your personal insurance agent to assure compliance. The other significant changes from the previous statute impacting your personal insurance are as follows:
  • Heating, ventilating, and air conditioning (HVAC) equipment is now the insurance responsibility of the Association and not the unit-owner. However, the maintenance responsibility of this equipment has not changed and is still defined in the condominium declarations.

  • The unit owner policy shall include at least $2,000 of loss assessment coverage

  • On your policy please have the Condominium added as an additional named insured and loss payee.

Please contact your current agent and have them provide an Acord form 27 to your association manager listed above. In addition, please discuss the above changes in F.S. 718 and make sure your policy has the appropriate coverage based on the insurance responsibilities defined in F.S. 718.111. Please note: Upon failure to provide the above referenced certificate of insurance within 30 days of receipt of this request, the Association is authorized by F.S. 718 to purchase a policy on your behalf and the expense of this policy will be assessed against the individual unit-owner.
